In this presentation, Kate will explore the concept of contextual safeguarding and its relevance to civil claims against local authorities. It will examine emerging liabilities arising from gang-relates harm, such as stabbings and shootings, and child sexual exploitation, including grooming cases expected to be highlighted in the national inquiry. Kate will consider how these incidents lead to legal challenges against local authorities, focusing on their potential failings in safeguarding and intervention. She will also cover the role of local authorities in subsequent inquests and judicial review proceedings, offering practical insight into current legal duties, procedural obligations, and the broader implications for risk management and accountability.
Kate is a Partner in the specialist liability team at DAC Beachcroft. She has specialised in abuse, neglect, safeguarding and mental health claims for over 20 years and has a wealth of experience in advising local authorities, educational institutions, and sporting bodies. Kate is uniquely placed to support organisations in their safeguarding practices, having extensively trained with some of the UK's leading safeguarding organisations.
