In this session, experts will review the law in relation to what constitutes a lawful arrest. They will look at the grounds of suspicion and necessity criteria with consideration of ALK v Chief Constable of Surrey Police. They will also consider how Article 5 of the European Convention on Human Rights engages in wrongful arrest claims.



Trainee Solicitor, Kennedys
His claims usually involve complex duty of care issues and often contain allegations of human rights breaches. His work for police forces includes claims arising from use of force, false imprisonment, malicious prosecution and misfeasance in public office.
Partner, Kennedys
Rebecca is a Partner in the Public Sector, Abuse and Specialist Liability Team and is based in Kennedys' London office. She specialises in the defence of complex liability claims for the public sector and has worked in this area for almost 20 years. Her clients include local authorities, police forces and their insurers. She also handles claims for schools and other institutions on instructions from insurers.
Rebecca’s practice includes the defence of abuse claims, human rights claims and other claims involving complex duty of care issues. She is also regularly instructed in Inquests.
Rebecca has developed a specialist data breach practice defending data and privacy claims for our public sector clients and is well known in the market for her work in this area.

Tom works as part of the Kennedys specialist liability team, which is part of their public sector, abuse and specialist liability team.
Tom qualified in 1992 at Barlow Lyde and Gilbert, until its merger with Clyde and Co. He moved to DAC Beachcroft in 2007 as a partner, and joined Kennedys in 2023. He qualified as a solicitor in England and Wales.
He is a leading public sector defence lawyer, and also defends other companies and organisations in claims relating to allegations of breach of duty and breaches of the Human Rights Act. Listed for many years in Chambers directory for his work for the police, Tom has handled some of the most important cases relating to powers of arrest.
Amongst high profile and reported cases that Tom has dealt with, he recently defended a leading University in a widely publicised claim for bullying at work, and is currently working on a number of complex and sensitive inquests for other clients.
Tom also has an extensive practice advising on the sensitive and difficult area of claims for neglect and harm to vulnerable children and adults.
